TERMS AND CONDITIONS
By checking the box and purchasing from Lifeguard Training NY LLC ("the Company," "We", "Us" or "Our"), you ("the User," "You" and "Your") agree to be bound by these Terms and Conditions and affirm that you are either the Participant and over the age of eighteen (18), or You are the authorized legal parent or guardian of a Participant under the age of eighteen and authorize this application and purchase. Participation in this course is conditioned on compliance with these Terms and Conditions and may be revoked by the Company at any time for violations.
You agree to make full payment via the Company’s third-party payment processor, such as Square. We do not store credit card information. By purchasing, You authorize the transaction and agree to the processor’s terms. No order is binding until accepted by the Company and a confirmation is sent with course details.
You grant the Company the right to use the likeness of You or the Participant in photos, video, or other media for marketing or publication without further approval or compensation. You waive rights to inspect or approve finished materials and release the Company from all claims related to the use of these materials.
If You cancel within 24 hours of purchase, You will receive a 75% refund. After 24 hours, no refunds will be issued, but You will receive a credit for another class, valid for one year. If the Company cancels a course, it will be rescheduled but no refund will be issued unless you decline the rescheduled date, in which case you are entitled to a full refund.
If you reschedule to another class and later cancel, we will provide you with credit valid for one year. Once you commence the lifeguarding class and are unable to attend the second day, it is mandatory to reschedule and successfully complete your second class within a 30-day window.
There are no refunds or reductions due to absences or illnesses.
Make sure you meet the minimum age requirement. If there are any prerequisites, make sure you can pass them. If you do not meet the minimum age or cannot pass the prerequisites, there will be no refunds. You will instead receive credit valid for one year.
If you signed up within 72 hours of the class start time, no refund will be issued, even if canceled within 24 hours.
If you signed up for a class and want to reschedule to another class, a $50 rescheduling fee will apply.
If you want to take a Lifeguard Re-certification class, you must have a current lifeguarding certificate or one that expires within 45 days. This requirement was extended from 30 days.
We reserve the right to cancel any class or send any student home who is not feeling well.
As a company created by First Responders, we offer all First Responders, Nurses, Doctors, and their immediate families (Father, Mother, Sister, Brother, Son, Daughter) 5% off all classes. Please call us at (718) 954-5567 for more information. The first responder ID must be submitted within 72 hours of registration. If you know someone qualified for this discount, please let them know.
By purchasing from Lifeguard Training NY LLC, You agree not to initiate a chargeback. Filing a chargeback in violation of these Terms constitutes a breach of contract. If You initiate a chargeback, You agree to reimburse the Company for all associated costs, including merchant fees, administrative costs, and reasonable attorney's fees and court costs.
In addition, if You leave a negative review online (Google, Yelp, Facebook, etc.) while simultaneously filing a chargeback or disputing the payment through any financial institution, You agree to pay Lifeguard Training NY LLC a liquidated damage fee of *$10,000*, recognizing the reputational harm such conduct causes. This fee is enforceable under contract law.
The Company reserves the right to amend these Terms and Conditions at any time.
Only the Participant may complete course work. Sharing links, passwords, or reproducing proprietary content is prohibited. The Company may terminate participation without refund for violations. You agree to comply with all applicable laws and not misuse the Website or Platform.
Lifeguard Training NY may reschedule classes. Participants will be notified. No refunds are provided for rescheduled classes. Participants may transfer, subject to availability. The Company is not liable for damages due to class changes. Disputes are resolved via binding arbitration. NY State law governs. Legal actions must be filed in Nassau County.
You may not use automated tools or processes to copy or interact with the Website or Platform without written consent.
The Company provides all services, materials, and content “as is” without warranties of any kind, express or implied. We are not responsible for service interruptions or inaccuracies.
Damages, if any, shall be limited to the purchase price of the course.
You agree to hold harmless the Company and its affiliates from all damages, losses, and legal fees related to Your or the Participant’s participation, including injuries, technology issues, and third-party claims.
Participation involves inherent risks. You assume all such risks and agree not to hold the Company liable for injuries or death.
You are responsible for the Participant’s safety and transportation. The Company is not responsible before or after course hours.
The Company and American Aquatics and Safety Training reserve the right to revoke certifications at any time if fraud, misconduct, or improper performance is found.
All course content is the proprietary property of the Company or its licensors. Unauthorized use, distribution, or reproduction is strictly prohibited.
You agree to indemnify and hold harmless the Company for any legal costs, fees, or damages resulting from Your or the Participant’s violation of these Terms or misuse of services.
We do not guarantee the privacy or confidentiality of any data submitted or transmitted through the Website or Platform.
These Terms are governed by New York State law. Any legal action must be filed in Nassau County, New York.
Any claim arising out of these Terms must be filed within one year from the event giving rise to it.
Sections regarding indemnification, limitations of liability, arbitration, intellectual property, and refunds will survive termination of this Agreement.
By purchasing, You agree that this electronic agreement is legally binding under E-SIGN, UETA, and other applicable laws.
If any clause is found unenforceable, the rest of the Agreement remains in effect.
The Website is intended to comply with the Americans with Disabilities Act. Report accessibility issues to admin@lifeguardtrainingny.com before claiming inaccessibility.
Participation in or completion of a course does not guarantee employment or placement with any organization or facility.
The Company reserves the right to refuse service or remove a participant from class, without refund, for disruptive, inappropriate, or unsafe behavior.
By registering a minor, you acknowledge and accept full responsibility for their participation and agree to all terms on their behalf.
